Terms of Service
The agreement between NailFlowApp and the salons that use it.
These Terms of Service (“Terms”) are an agreement between American Nails and Spa LLC (“NailFlowApp”, “we”, “us”) and the business that uses NailFlowApp (“Salon”, “you”). By using NailFlowApp, you agree to these Terms.
1. The service
NailFlowApp is salon management software for salons: online booking, appointment texts, check-in, turns, checkout and receipts, gift cards and offers, reports and payroll tools, provided through the web and the NailFlowApp app. Features may differ between salons and may change over time.
2. Accounts and security
- You are responsible for the people you give access to (owners, managers, front desk and stylists) and for keeping passwords, PINs and sign-in codes private.
- Tell us right away if you believe someone used your account without permission.
- NailFlowApp support signs in to your account only when you give us the one-time support code sent to the owner’s phone. Each support session ends automatically after 2 hours and is recorded in your log.
- NailFlowApp manages some technical settings for you, such as which phone number sends your automatic texts, and may change them to keep the service working.
3. Your responsibilities
- Keep the information you enter (services, prices, hours, staff, taxes) accurate, and follow the laws that apply to your salon, your staff, your pay records and your taxes.
- Use NailFlowApp only for your salon’s lawful business – no spam, no unlawful content, and no attempts to break into, copy or overload the service.
4. Text messaging
You are responsible for having your clients’ permission to text them, for honoring STOP requests, and for following the Telephone Consumer Protection Act (TCPA), CTIA guidelines and other laws on texts. NailFlowApp helps: appointment texts go to clients who book or ask you to book for them, offer texts go only to clients who chose to receive offers, and NailFlowApp stops automatic texts to numbers that reply STOP until they reply START. Automatic texts may be sent from a texting number shared with other salons that use NailFlowApp, as described in our Privacy Policy.
5. Payments
NailFlowApp is not a payment processor, is not connected to any payment processor today, and is not a party to your card transactions. Card payments are processed by your payment processing company under its own merchant agreement and terms. NailFlowApp does not receive or store full card numbers. If NailFlowApp offers integrated card payments through a processing partner in the future, those payments will be subject to that partner’s terms, which you will accept separately.
6. Fees, billing and refunds
Fees for NailFlowApp are set out in your order form or written agreement with us. Unless that agreement says otherwise, subscription fees are billed monthly in advance, you may cancel at any time, your access continues until the end of the paid period, and fees already paid are not refundable. If no fee has been agreed, none is charged.
7. Your data
Your salon’s data belongs to you. We handle it as described in our Privacy Policy. You can ask for an export of your data at any time.
8. Our software
NailFlowApp, including its software, design and content, is owned by NailFlowApp and protected by law. We give you a limited, non-exclusive, non-transferable right to use NailFlowApp for your salon while these Terms are in effect. You may not resell, copy or reverse-engineer the service.
9. Availability and changes
We work to keep NailFlowApp running and your data backed up, but we do not guarantee uninterrupted service. Some features depend on others (for example phones, mobile carriers, the SMS gateway service, Apple, Google and our hosting provider). We may update or improve the service; if a change materially reduces what you rely on, we will tell you in advance where practical.
10. Disclaimers
NailFlowApp is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows.
11. Limitation of liability
To the fullest extent the law allows, NailFlowApp is not liable for indirect, incidental, special or consequential damages, lost profits, or texts or notifications that are late or not delivered. Our total liability for any claim is limited to the amount you paid NailFlowApp in the 12 months before the claim.
12. Ending the service
You can stop using NailFlowApp at any time. We may suspend or end access if these Terms are broken or the service is misused. When the service ends, you can ask for an export of your data within 30 days; after that we may delete it.
13. Governing law
These Terms are governed by the laws of the State of Iowa, USA, and any dispute will be heard in the state or federal courts located in Polk County, Iowa.
14. Changes to these Terms
If we change these Terms, we will update this page and the dates above, and notify salons of significant changes.
